KESADARAN HUKUM IMPLEMENTASI TAKLIK TALAK DALAM PERKAWINAN

Abstract

Following the Compilation of Islamic Law (KHI), article point e states that taklik talak is an agreement made by the prospective groom after the marriage contract which is included in the marriage certificate in the form of a promise of talak which is dependent on certain circumstances that may occur in the future. Description of the facts that occurred in Sangen Village, Geger District, Madiun Regency, namely that the husband was not aware of the law in implementing the contents of the marriage divorce agreement. This happens because the husband does not understand the important meaning in the content of the divorce agreement, so the husband’s legal awareness is at a low-level result in the husband acting arbitrarily against the wife's rights. The purpose of this writing is to determine the awareness of the legal implementation of the contents of the taklik talak at the point of leaving the wife for 2 consecutive years as to educate the wife's rights in Sangen Village, Geger District, Madiun Regency, and to find out legal awareness in the implementation of the contents of the taklik talak at the point of not giving mandatory subsistence living for 3 months in Sangen Village, Geger District, Madiun Regency. From this research, it can be concluded that the husband's legal awareness in the implementation of the divorce “taklik” content is at a low level, because the husband only knows the law without understanding and internalizing it well in building his household.
